Thumbnail Pack Content License

This licence covers the content of the Spidx Thumbnail Pack V3 (the "Pack") that you receive when you buy it: the Spidx Uploader features unlocked by the SPT role (the MOGRT template browser and Properties in Premiere Pro, and Replace Text in After Effects; the other Pro features are licensed separately); 35+ in-depth tutorials; 10+ presets (old and new); updates; settings; clips of top cliphitters and pro players; and more. It is delivered by access to a private Discord server and by download links. The Spidx Uploader software and its panels are licensed under the EULA. The Terms of Service and the Refund and Withdrawal Policy also apply.

1. What you may do

When you have bought the Pack, we grant you a non-exclusive, non-transferable, worldwide, perpetual licence to:

• use the presets, settings and templates in your own videos, streams, thumbnails and other productions, personal or commercial;
• use them in work you create for your clients, as part of the finished work;
• publish the finished work anywhere: YouTube, Twitch, social networks, broadcast, events and so on;
• edit and adapt the presets, settings and templates for your own work;
• watch the tutorials for your own learning and use what you learn in your work; and
• use the clips as described in section 3.

No credit is required. This licence is for one person: the buyer. A team needs one licence for each person who uses the files. Anyone else who needs to use the Pack needs their own licence. The licence does not expire.

2. What you may not do

You may not:

• resell, redistribute, share, lend, rent, upload or publish the Pack's files, tutorials, presets, settings, templates or clips themselves, original or modified, in a way that lets others take them (including file-sharing sites, Discord servers, marketplaces, courses and template libraries);
• share your Discord access, the invite or your download links, or let another person use your access;
• record, re-upload or sell the tutorials, or use them to teach a paid course;
• include the Pack, or large parts of it, in a pack, plugin, preset collection, course or other product that is sold or given away;
• sublicense the Pack or give your licence to someone else;
• claim to be the author of the Pack's content; or
• use the Pack in content that is unlawful, defamatory, hateful or that infringes the rights of others.

3. Clips and other third-party material

The Pack includes video clips that were found among content published by their creators (clip makers and players). We do not own these clips and we do not license them to you. You may edit with them (for example to practise, or in your own edits) as far as the creators' own publication and the rules of the platform and of the game publisher allow, and you stay responsible for having the right to publish the finished work. The creators keep all rights in their clips. You may not resell or redistribute the clips. If a rights holder asks us to remove a clip, we will do so, and you must stop using that clip in new work.

The templates and presets are designed with the typeface Burbank Big, which is not included in the Pack. We do not own or license that typeface. To see the templates as designed you need your own right to use it, or you can choose another font.

Some designs and clips show or imitate video games. Fortnite is a trademark of Epic Games, Inc. and other game names are trademarks of their owners. We are not affiliated with or endorsed by them. You are responsible for following the content and trademark rules of the publisher of any game you show in a video that uses the Pack.

4. Updates

Updates are free for everyone: users of the free version, Pro License holders and Pack buyers receive updates of the App and of the products they bought at no extra charge. A separate new product (for example a future pack with a different name) is not an update and may be sold separately; the product page says so before you buy.

5. Ownership

We, our licensors and the creators of the included clips keep all their rights. You receive a licence to use the Pack; you do not receive ownership of the content.

6. Access, misuse and ending the licence

Access is for the buyer only. If the Pack is shared in breach of section 2, or the rules of the Discord server are broken, we may withdraw access, switch off the Pack's features in the App for the account concerned, and take the legal steps the law allows. We may refuse access, and what happens to the price in that case, is explained in the Terms of Service and the Refund and Withdrawal Policy.

7. Refunds

The Pack is non-refundable once access to the Discord has been granted. Your statutory rights are not affected, and they are explained in the Refund and Withdrawal Policy.

8. No warranty beyond the law

The Pack is provided as described on the product page. Your rights as a consumer are not affected. Beyond that, and as far as the law allows, we are not liable for indirect loss or for results in your projects. Business customers: section 10 of the Terms of Service applies.
