These Terms of Service ("Terms") apply to your use of Spidx Uploader, including its Windows application, its plugins and panels for supported editing software, its add-ons, the website at spidxuploader.com and the online store at spidxshop.com (together, the "App").

These Terms work together with the following documents, which form the agreement between you and us:
If documents conflict, the information shown at checkout comes first for the product you are buying, then the EULA or the Thumbnail Pack Content License for that product, then these Terms. Nothing in these Terms limits rights that the law gives you as a consumer and that cannot be waived.
Spidx Uploader helps you export images from supported editing software, compress them and upload them to a destination you choose. Supported software and versions are listed on the website and may change.
The features available to you depend on the product you bought, your version of the App, your operating system and third-party services. We may change, replace or retire features, but we will not remove a paid feature you have already bought without offering a fair alternative or refund, unless the law allows otherwise or the change is needed for security or legal reasons.
You accept these Terms and the other documents listed above when you set up the App (the setup wizard asks for it), when you buy in the store (the checkout asks for it) or, if they change materially, when the Dashboard asks you again. If you do not agree, do not install or use the App.
You must be able to enter into a binding contract where you live. If you are under the age of digital consent in your country, a parent or guardian must agree on your behalf.
You may use the App for lawful personal or professional purposes. You must not use it to:
You keep ownership of the files and images you process or upload with the App ("User Content"). You are responsible for having all rights and permissions needed to process, upload and share it. We do not claim ownership of your User Content, and we do not receive copies of it on our own servers: files go from your computer straight to the destination you choose.
The App can upload to Google Drive and WorkUpload. When you start an upload, you tell the App to send the selected files to that destination. After that, the destination provider's terms and privacy policy apply to the files, including how long they are kept and who can open the link.
The App also works with, or depends on, Google sign-in and APIs, GitHub (update checks), Adobe applications and VEGAS Pro. These are run by other companies and can change or stop working. Adobe, Photoshop, After Effects and Premiere Pro are trademarks of Adobe Inc. VEGAS Pro is a trademark of its respective owner. Fortnite is a trademark of Epic Games, Inc. We are not affiliated with any of them.
Paid products are sold through our store (https://spidxshop.com), with payments handled by Stripe. The product page and checkout show the product, the price, the currency, what is included and the licence conditions. The price you pay is shown at checkout before you pay.
After your payment is confirmed you can download a file ("Thank You For Buying.txt") from the confirmation page. We also send you an email with a link to that page. The file contains your order number and instructions. The file can be downloaded a limited number of times (currently 5 per order). For the Spidx Thumbnail Pack V3 you then message us on Discord (vfxspidx) and we give your account access to the private server. Access can be issued manually after we verify the purchase, so delivery can take up to 24 hours (usually much faster). Licence codes are not sent through the store: a Pro License that is part of your offer is given to you in Spidx Uploader after you have been given access to the Pack. Enter the licence code in the App's Dashboard (Account → Activate).
The Spidx Thumbnail Pack V3 is delivered by giving your Discord account access to a private server and its content. Access is for the buyer only: do not share your access, the invite or the content with others. One purchase gives access to one Discord account. We may refuse access, or withdraw it, if we reasonably believe that you are using an alternative account to get around a ban or a rule, that the purchase or the access is fraudulent or abusive, or that you broke the rules of the server or the Thumbnail Pack Content License. If we refuse access before it has been delivered, we refund the price. If we withdraw access after delivery because of such a breach, no refund is due, unless the law requires one. Discord's own terms apply to your use of Discord.
The Spidx Thumbnail Pack V3 is non-refundable once access has been granted, and the Pro License is non-refundable once the licence code has been delivered. Your statutory rights are not affected. Your right of withdrawal, and how it ends when delivery of a digital product starts, are explained in the Refund and Withdrawal Policy.
Updates are free for everyone: users of the free version, Pro License holders and Pack buyers receive updates of the App and of the products they bought at no extra charge. A separate new product (for example a future pack with a different name) is not an update and may be sold separately; the product page says so before you buy.
We also provide the updates needed to keep what you bought in conformity with the contract, as the law requires. We do not promise that every version of the App works with every computer, operating system or future version of third-party software.
Support is available at contact@spidxshop.com and through the support tickets on our Discord server. Please describe the problem and attach a diagnostics file (Dashboard → Account → Diagnostics). Do not send passwords, sign-in tokens or payment-card details. We do not promise a fixed response time unless the offer you bought says so.
We work to keep the App reliable, but it can be interrupted by maintenance, bugs, network problems or changes at third-party services. Uploads can fail. Keep your own copies of important files and check that an upload really finished before you delete the original.
If you are a consumer, the App must conform to the contract and you have the legal remedies that apply (for example repair, price reduction or termination and refund). Nothing in these Terms limits them.
For everything else, and to the extent the law allows, the App is provided "as is". We are not liable for indirect or consequential loss, lost profit, lost data or lost files, except where the law does not allow us to exclude it (for example for intent, gross negligence, injury or death). If you are a business customer, our total liability for a claim is limited to the price you paid for the product concerned.
We may suspend or end your access or licence if it is reasonably necessary to deal with fraud, a serious security risk, unauthorised licence use or a material breach of these Terms. Where reasonable we will tell you first and give you the chance to fix the problem. If we end a paid licence without it being your fault, we will refund the part of the price that corresponds to what you could no longer use. Your rights as a consumer stay unaffected.
We may update these Terms when the App, our practices or the law change. The date at the top shows the latest version. If a change is material, the App asks you to accept the new version. Changes do not apply to a purchase you already made if that would be to your disadvantage and the law does not allow it.
These documents are governed by the law of Poland. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live, and you may bring a claim in the courts of that country. If you are a business, the courts competent for our seat decide.
As a consumer you can also use out-of-court dispute resolution and the help of consumer protection bodies. In Poland, for example, these are the municipal or county consumer ombudsman (Rzecznik Konsumentów), the Office of Competition and Consumer Protection (UOKiK) and the consumer arbitration courts.
